Horowitz Law Sues Titusville Business for Sexual Abuse by Massage Therapist Thomas Grasso

Horowitz Law has filed a lawsuit alleging sexual assault by massage therapist Thomas Grasso.  The lawsuit was filed in Brevard County against Daly Chiropractic and Wellness Center in Titusville and arises from an alleged sexual assault of a female patient by massage therapist, Thomas Gregory Grasso.   Daly Chiropractic and Wellness Center referred its patient to  Thomas Grasso for massage services despite previously having previously received reports that Thomas Grasso was sexually inappropriate toward female clients, according to the Complaint.

Grasso was arrested in December 2020 and charged by Titusville Police after multiple female clients of reported alleged incidents of sexual assault to law enforcement. During the initial battery investigation back in 2020, detectives found evidence that Grasso committed sex crimes against over 22 female clients/ Grasso has been a licensed massage therapist in the State of Florida since 1993.

According to the newest lawsuit, the alleged victim stated that she attended Dr. Daly’s Chiropractic Clinic located in Titusville, on September 10, 2020, for chiropractic treatment, followed by a 60-minute massage performed by Thomas Grasso. During the massage, Grasso exposed his penis and placed it in between the victim’s fingers. Grasso then placed his unclothed penis on the client’s hands, left arm, and feet several times throughout the massage. When the victim saw what Grasso was doing, she immediately got up in shock, dressed, and left the room. She ran out so fast, that she forgot her necklace. The victim then reported Thomas Grasso to the Titusville Police Department.

Following Grasso’s arrest in 2020, the Florida Department of Health ordered the emergency restriction of Grasso’s license for flagrantly disregarding the laws and regulations governing massage therapists. In May 2021, Grasso surrendered his license to practice massage therapy in Florida. Grasso was then criminally charged with two counts of Sexual Battery, two counts of Battery, two Counts of Lewd or Lascivious Molestation of an Elderly Person, and one count of Aggravated Battery on a Pregnant Woman. He was arrested during a traffic stop and booked into the Brevard County Jail with a bond set at $96,000. Additional charges, 43 counts of battery and 14 counts of exposure of sex organs, were sent to the State Attorney’s Office for review.

When clients book a massage, it is to decompress from the stresses of life. They trust that the massage therapists employed at the spa will act professionally and expect they are carefully vetted and safe to engage with the public. It is unacceptable, immoral, and unlawful for any employee to touch a client in a sexual manner.
