Diocese of San Diego Horowitz Law

The Roman Catholic Diocese of San Diego filed for Chapter 11 bankruptcy in June 2024 to address hundreds of clergy sexual abuse claims brought against the Diocese due to the sexual misconduct of its clergy and other employees. This move was part of a broader trend, as several other dioceses in California and across the United States have also filed for bankruptcy in recent years for the same reason. Horowitz Law has filed claims on behalf of sexual abuse survivors in this and each of the cases in which the Catholic diocese in California has filed for bankruptcy. The Diocese of Sacramento, the Diocese of Santa Rosa, the Diocese of Oakland, and the Archdiocese of San Francisco have already filed for bankruptcy protection in the wake of child sexual abuse lawsuits.

On November 15, 2024, Judge Christopher Lathman of the US Bankruptcy Court for the Southern District of California ruled that all claims alleging sexual abuse must be submitted by February 3, 2025. Survivors have until February 3 to submit their claims form or else their claims may be deemed untimely. It is essential to contact an attorney in advance of the February 3 deadline to submit a proper claim with any accompanying evidence of the abuse and damages. Prior to the bankruptcy being filed, the Diocese of San Diego had already been named as a defendant in over 450 lawsuits alleging sexual abuse. It is expected even more claims will be brought before the February 3 deadline.

Understanding the Process

  1. Know Your Rights: As a survivor, you have the right to file a claim for compensation. The claims process is part of the bankruptcy proceedings of the Diocese of San Diego, which aims to address the financial liabilities arising from abuse cases.
  2. Gather Documentation: Collect any relevant documents that support your claim. This may include sacrament records, medical records, therapy notes, police reports, or any correspondence related to the abuse.
  3. Seek Legal Advice: It’s crucial to consult with an attorney who specializes in bankruptcy and sexual abuse cases. They can provide guidance on how to file your claim and ensure that your rights are protected throughout the process.

Filing Your Claim

  1. Obtain the Claim Form: The Diocese of San Diego will provide a specific claim form for survivors. This form can usually be found on their Court’s website or through your attorney.
  2. Complete the Form: Fill out the claim form with as much detail as possible. Include information about the abuse, the impact it has had on your life, and any financial losses you have incurred as a result.
  3. Submit Your Claim: Ensure that your claim is submitted before the February 3, 2025 deadline. Late claims may not be considered, so it’s important to act promptly.
