On July 2, 2026, Horowitz Law filed a civil lawsuit against Massage Envy's West Boca Raton franchise (BH Boca LLC), alleging Massage Envy failed to protect a customer who was sexually assaulted by massage therapist Xavier Havenol Robinson during a massage appointment.
The complaint, filed in Palm Beach County Circuit Court, alleges the assault occurred on November 1, 2025, while the Plaintiff was receiving a 90-minute massage at the Massage Envy location at 7050 W. Palmetto Park Road in Boca Raton, Florida.
Massage Envy is one of the nation’s largest massage therapy franchises, operating approximately 1,100 locations throughout the United States.
The Plaintiff is represented by sexual abuse attorneys Adam Horowitz and DeeDee Scheller of Horowitz Law.
Allegations in the Complaint
According to the lawsuit, the Plaintiff scheduled a 90-minute massage and specifically instructed Robinson to focus on her shoulders and back because she did not want her legs massaged. Although she initially declined leg work, Robinson allegedly persuaded her to allow him to massage her legs briefly.
The complaint alleges that during the massage Robinson repeatedly adjusted the draping covering the Plaintiff’s body, leaving her exposed without her consent. The lawsuit further alleges that Robinson pulled down the Plaintiff’s underwear, sexually touched her breasts and vagina, digitally penetrated her, and climbed onto the massage table while she froze in fear.
According to the complaint, Robinson continued the alleged assault despite the Plaintiff’s attempts to move away. The lawsuit further alleges that Robinson pressed his body against the Plaintiff before the massage ended.
The Plaintiff alleges she immediately disclosed the incident to her boyfriend after returning home. The following day, the alleged assault was reported to Massage Envy, law enforcement, and the Florida Department of Health.
Claims Against Massage Envy West Boca
The lawsuit alleges that Massage Envy West Boca Raton failed to take reasonable steps to protect clients from foreseeable sexual misconduct by massage therapists.
Specifically, the complaint asserts claims including:
- Negligence
- Negligent hiring
- Negligent retention
- Negligent supervision
- Vicarious liability
The complaint further alleges that Massage Envy knew or should have known that sexual misconduct by massage therapists presented a foreseeable risk to customers and failed to implement adequate safeguards designed to protect clients receiving massage therapy services.
According to the complaint, Massage Envy’s policies and procedures allegedly failed to require reports of sexual misconduct to be made to law enforcement or state licensing authorities, allowing complaints of inappropriate sexual conduct to remain “in house.”
Prior Administrative Action
The allegations in the lawsuit stem from the same incident that led the Florida Department of Health to issue an Emergency Suspension Order against Robinson’s massage therapy license.
According to the Department of Health, Robinson posed an immediate and serious danger to the public, and his massage therapy license was immediately suspended pending disciplinary proceedings.
