Frequently Asked Questions About Suing For Sexual Assault During a Massage

When handling Massage Envy sexual assault cases, the questions we see most often include:

What is unwanted touching?

Contact with any sexual organ is outside of the bounds of a traditional massage.

Who can be held liable for massage therapist assault?

Liability may extend beyond therapists. Most of our lawsuits target the therapist's employer, accusing Massage Envy and other business of negligence in keeping clients safe, neglecting to complete a proper background check and failing to properly investigate complaints,

What should I do if I have been assaulted by a Massage Envy therapist?

Begin exploring your legal options by meeting with an experienced sexual assault attorney. They can investigate your circumstances and help you make informed decisions about how to proceed.  Options include filing a police report, making a report to licensing authorities, seeking an Order of Protection, and bringing a civil lawsuit.  Trauma can often be emotionally unsettling and many of our clients seek therapy from a trained professional. You are not alone if you have experienced sexual assault at Massage Envy. We are here for you when you need us most.

Is it okay if I didn't immediately stop the assault?

Yes, we receive this question quite often.  Often times due to shock and fear of the sexual contact, the massage client will go into an involuntary "freeze response" to cope with the trauma of the assault. This is a completely normal physiological response because the sexual contact is unexpected, and the brain was previously attempting to go into a state of relaxation. Due to the "freeze response", a client sexually assaulted in the massage setting often fails to immediately scream for help or otherwise report an assault. Sometimes victims of sexual assault experience guilt or shame if they did not immediately stop the sexual contact or report it right away. The "freeze response" is a completely normal response and the victims should not feel shame or guilt.  Our team of experts is prepared to explain this conduct.
